Terms of Service

By accessing or using InCoko ("the Platform"), operated by Biz Digital IT ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Platform.

InCoko is a Conversational AI Studio that enables businesses to create, test, and deploy voice AI agents. The Platform provides tools for agent configuration, voice call management, campaign execution, appointment scheduling, and analytics.

Access to InCoko requires an approved account. You must provide accurate and complete information during the access request process. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these terms.

You agree not to use the Platform to:

• Violate any applicable laws or regulations
• Make calls to numbers on the Do Not Call registry in violation of TCPA regulations
• Engage in harassment, fraud, or deceptive practices
• Impersonate any person or entity
• Transmit malware, spam, or other harmful content
• Attempt to gain unauthorized access to systems or data
• Interfere with or disrupt the Platform's infrastructure
• Use the Platform for any illegal or unauthorized purpose

Agent Configuration

You are solely responsible for the content and behavior of AI agents you create. This includes knowledge bases, greeting scripts, call flows, and any information your agents communicate to callers.

Industry Compliance

If you operate in a regulated industry (e.g., legal, medical, veterinary, funeral services), you are responsible for ensuring your AI agents comply with applicable industry-specific regulations. InCoko provides compliance disclaimers during setup but does not guarantee regulatory compliance.

DNC & TCPA Compliance

You must maintain accurate Do Not Call (DNC) lists and comply with the Telephone Consumer Protection Act (TCPA) and any applicable state telemarketing laws, including restrictions on calling hours (8am-9pm in the recipient's time zone).

InCoko uses artificial intelligence to power voice agents. While we strive for accuracy, AI-generated responses may contain errors or inaccuracies. You acknowledge that:

• AI agents may not always provide correct or complete information
• AI agents are not a substitute for professional advice (legal, medical, financial, etc.)
• You are responsible for reviewing and validating agent behavior before deployment
• AI-generated call insights (summaries, sentiment analysis) are approximate and should not be relied upon as the sole basis for business decisions

The Platform, including its software, design, and documentation, is owned by Biz Digital IT and protected by intellectual property laws. You retain ownership of all content you create on the Platform, including agent configurations, knowledge bases, and campaign data.

You grant us a limited license to use your content solely for the purpose of providing and improving the Platform services.

Your use of the Platform involves the processing of personal data as described in our Privacy Policy. By using the Platform, you acknowledge and consent to our data processing practices.

We strive to maintain high availability but do not guarantee uninterrupted access to the Platform. We may perform maintenance, updates, or experience outages that temporarily affect service. We will make reasonable efforts to notify you of planned maintenance in advance.

To the maximum extent permitted by law, Biz Digital IT shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Platform.

Our total liability for any claim arising from these terms or your use of the Platform shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless Biz Digital IT, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform, your violation of these terms, or your violation of any third-party rights.

We may suspend or terminate your access to the Platform at any time for violation of these terms or for any other reason at our discretion. You may request account deletion at any time by contacting us. Upon termination, your right to use the Platform ceases immediately.

These terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms shall be resolved in the courts of competent jurisdiction.

We may update these terms from time to time. We will notify you of material changes by posting the updated terms on this page. Your continued use of the Platform after changes constitutes acceptance of the updated terms.
